Trade Marks

A trade mark distinguishes your goods or services from your competitors and acts as both an indication of origin and quality. A trade mark can be a word or logo, shape, colour, sound or smell.

Trade mark registration gives you exclusive rights to use the mark in a given territory for the quoted goods or services and allows you to prevent unauthorised use of the identical or a similar mark for identical or similar goods and services.

Leaving your mark unregistered could lead to a situation where a third party registers an identical or similar brand for the same or similar services and asks you to stop using your mark. Whilst such claims can be challenged, doing so is long-winded and costly, it is far better that your brand is protected.

Registration is relatively quick and inexpensive and gives you exclusivity in a brand for an initial period of 10 years, renewable in perpetuity.
